Well quite shocking the other day I actually got a letter from the Ministerio Del Interior telling me what I need to get a residency permit. It only took 6 months!
Anyways work has agreed to pay for a lawyer to expedite my application and he looked at our paper work and told me.

Yes, you might need to get a new marriage certificate issued with an apostille (certification) attached. Call the Canadian consulate to find out for sure (the American consulate will not do apostilles, maybe Canada is nicer).
The reason that you need this is that legally any documents issued in a foreign country (national or local) need this certification in order to be valid in another country. When you get the apostille, you need to specify that it is for Spain, because there are different kinds of apostilles.
