Hi All,

I have a doubt here. I would like to put a "denuncia" to my extremely annoying neighbor.

See I put this A/C in my place, and now she keeps coming up and complaining about the noise it makes, or when she sees me on the street she will start calling me stuff. She also comes around 1:30am and starts ringing my doorbell like a maniac. Last year, I kind of let things go by, since I didn't have the license you are supposed to have, prior to installing the A/C but this year I have it, so it�s all legal now. Any advice? Should I just live with it? or is there something I can do to effectively stop her?

If it's noise related there does exist a' noise test'.One year we lived above a bar and had it done. Basically a measurement can be done of how much noise is being emitted and evaluated if it's above the legal level.
If your AC was too high, she may be technically right. If not, well she hasn't got a leg to stand on and start by reminding her of it.. that MIGHT do the trick if you're lucky.

Hey Euro,

Thanks for the advice, I tried that already and she still doesn't stop. I checked the maximum allowed noise in my area even at night, and my A/C is below that maximum level. I mentioned it to her, but she keeps going at it.

i had exactly the same problem! the thing was my neighbour was pissed off cose of the hot air that came through her open windows....we just live with it and try not to put the a/c after 12 am. so she can sleep fine...anyway, i'm a lawyer so i'll check with my friends that actually KNOW the laws!

Yeah, she used that argument with me too. But she is my downstairs neighbor, so I explained to her that that was impossible since hot air travels upwards. She still complained about that for a while. I also explained to her (when we were on speaking terms...) that the law only protects people who live above you on that matter...

Thanks freaky Wink did you get my email about that ascii art star wars episode? I sent it to the hotmail account you have listed on your profile. Which is something about you loving Orlando, which I thought was very odd, since I don't remember you mentioning ever living in Orlando...

my strawars freaks friends loved it as well....although the general opinion was that some people have too much time to spare!!!

and the i loove orlando...I've never been to orlando,fl (unfortunately)....It has a way more pathetic explanation...do you know Orlando Bloom?????

Hi rule,

just wanted to check what happened with your neighbour - I have a similar problem. My neighbour downstairs is totally mad - she started complaining about the noise the day we moved in, and when I spoke to the previous owners they admitted they had had problems with her for 7(!) years.

She filed a complaint against our a/c with the ayuntamiento, but they came and checked and said that it was alright. Then she started banging on the ceiling everytime we'd move within the flat (no matter morning, day, evening or night) and lately she's taking to calling us on the telefonillo and shouting abuse, as well as turning up at our door, kicking and hitting it and then running off to her own flat.

It's kinda comical in a way, but it's getting quite exhausting after 5 months. I have no idea how the previous family put up with it!!!

Yesterday I called the Policia Municipal, and they said that it's difficult to get her to stop the pounding on the ceiling, but that I could go to the Policia National to file a complaint about her harassing me. I'm going to do that, and I have also contacted a lawyer to see what else can be done.

Would be interesting to see if you managed to get anywhere with your neighbours - maybe you have some tips for me Frowner

Ok, you don't know how the formers owners of your appartment could live with that? ... They left. But if she filed any claim anywhere before they left, even if she is right the former owners would be responsible for it under Spanish law (they sold the house with hidden faults -"vicios ocultos"-; the name in Spanish may sound funny, but it is a legal figure that protects quite well buyers from unscropulous sellers). And if she is not right, she would have to stop. So, in this case I would not try to solve it with good manners, just file a complaint against her.

Sorry was busy getting everything done before I go on vacation...

Will be gone until Oct 10th, mostly to spend some time in whatever the hurricanes have left of Miami.

Anyway, we had a building meeting the other day. The lady started complaining as usual, I listed all the things that I have done to legally install the A/C in that window. She still said that it "bothered" her, and I had to take it out. A neighbour aproached me to say if I would agree to turn it off before 12am, I said I wouldn't commit to that. 1, because, I go to bed closer to 1am. 2. because I thought if I agreed to it, then the lady would start ringing at my door starting 11pm...

anyway, there was big commotion, the lady said I was just being mean and carless about her needs, I said she should see a psychologist and cited "aqui no hay quien viva" as a healthy evironment compared to our building, and it all ended the same way it does every time.

Ok, now they have asked if the community paid for it, would I move the A/C to the front of the building. I agreed to it, but said I wouldn't do it if I wasn't: 1. shown a permission by the "ayuntamiento" that says I can put that on the front of our building. 2. the community paid for licenses and work needed...

anyway, it looks like things are going well, thanks to the fact that I was able to get a letter form the president of the community saying I could put it there, because the statutes of the community did not disallow it.

So as a lessons learned kinda thing, If you are thinking of getting an A/C installed make sure you have the following:
1. Permission from your community to install it
2. A place that is not protected by the ayuntamiento (many building fronts are)
3. A license by the ayuntamiento prior to installing the appliance.

Y'all take care now, you'll either see me on the South Florida news or back on the 10th.
