even if it were, it is still too much to ask for a simple room rental in a shared flat. the only thing that would make sense would be if it were 1 month "fianza" (security deposit) and the first month�s rent. saludos, jer...

that�s what i was afraid of. asking for 2 months security deposit on a room rental in a shared flat with 2 others is robbery. that is 520 Euros that are dead and untouchable for the length of the new flatmate�s stay. maybe asking for a 2 month deposit on a full apt. rental would be more understandable but on a flatshare saludos, jer...

EXCELLENT point hilko, i never even thought of that. so, if the second deposit is being paid to the person who is leaving and the landlord has kept that person�s deposit, they may have negotioated it so that the landlord keeps the outgoing tennants deposit and the incoming tennant pays the outgoing tennant the deposit to get his/her deposit back. maybe the landlord is never around and it is just easier that way so that the landlord does not have to show his/her face (landlords are like that). that brings up the question of "where is the first deposit going?". to the 2 people already living there? saludos, jer... the first part of the second deposit agrees to the second part of the first deposit... (all i need is the stash and the glasses) :jeje:

I think you're right Jer, this kind of deal does not sound right to me. The landlord is dumping the responisibility of paying back to the tenant who is leaving, (onto the new incoming tenant) the money the he owes him/her, which surely cannot be a legal practice, and sounds like he is doing something dodgy to me, by doing that, it sounds like he might be trying to avoid showing those money transactions in order to avoid other charges and/or costs, where as he should be recording them on his books, and I think he is breaking the law by getting new tenants to pay up for him.
Although the place might be brill, and well priced, that's not the point, if he is pulling a dodgy-one at your expense, and everytime someone moves in/out, then in my opinion it's not worth it, and he sounds like an "A" hole for doing it like that in the first place, and I personally would have nothing to do with a landlord who operates in that way.

This sounds like what happened was that the person who is leaving must have agreed to stay longer than they wanted to or originally planned and now wants to try and get back their security deposit even though they are breaking their original promise to stay longer and supposed to lose it for leaving early. Most landlords will not rent their rooms for less than a specific time that is convenient for them, usually 9 months to a year. So the first person agreed to the minimum set by the landlord just to get the room / flat and then decided to leave earlier than what they originally agreed to and now wants to pass the buck on to the new person to finish out their contract so they can not only leave earlier than they originally agreed to but take their deposit money with them. It happens all of the time here in Madrid where landlords want to do what is in their best interest and the people renting want to be slick and try to beat the system.

Rocco!!! I absolutely agree with what you are saying!!!! I have just had a change of tenant, and they have agreed amongst themselves what is going to happen with regard to the deposit!!!!! I wonder if the landlord of this particular property knows what is happening... it is so easy to blame the landlord!
